Can I dismiss an employee during probation?
Not automatically. Probation does not remove an employee’s rights. Employers are still expected to act fairly, give guidance, assess performance properly and follow a fair process before dismissal.
Does a probation period mean an employee is not yet full-time?
Not necessarily. An employee can still be a full-time employee while serving probation. Probation is not a way to bypass labour law obligations or avoid fair process requirements.
Can I fire someone without giving a warning first?
It depends on the seriousness of the misconduct. Some cases justify stronger action immediately, but in many situations progressive discipline is expected. Employers should be cautious about acting too quickly without the right process.
What is constructive dismissal?
Constructive dismissal usually involves an employee claiming they were forced to resign because the working environment became intolerable. These matters can be difficult to prove, which is why proper conduct, records and communication are so important.
How do employers protect themselves against constructive dismissal claims?
By acting consistently, documenting issues properly, responding to grievances fairly, communicating clearly and avoiding conduct that could make continued employment intolerable.
What happens if an employee refers a matter to the CCMA?
The employer may need to respond to the referral, prepare documents, attend conciliation and possibly proceed to arbitration. Early preparation and proper records often make a major difference.
Can fixed-term contracts be renewed indefinitely?
Not always. Fixed-term contracts must be used carefully and for valid reasons where required. Employers should not assume that repeated renewals automatically avoid ongoing employment obligations.
What documents should every employer have in place?
